Section 700 - Health and Safety

Legal References: OSHA Blood-Borne Pathogens Standard, 29 CFP 1910.1030

Universal precautions will be observed at the College to prevent contact with blood or other potentially infectious agents/materials. All blood or potentially infectious materials will be treated as infectious regardless of the perceived status of the individual/circumstance.

Appropriate work practices, as described in the Implementation Procedures, will be used by those employees who potentially may be exposed to blood-borne or other infectious pathogens in the routine execution of their assignments. Exposure determination is found in the Blood-Borne Pathogens Procedures.

Employees and students are to contact a Building Maintenance Supervisor should an emergency situation require immediate containment and prevention measures. All Maintenance employees should know where the necessary protective equipment is stored, and Personal Protection Equipment Procedures to be used, in the event that a Building Maintenance Supervisor is not available.

702 - Communicable Disease (Prevention of Exposure)

The College encourages employees and students suffering with an airborne communicable disease (other than the common cold) to take preventive measures to limit exposure of others. Until such time as overt symptoms have subsided or appropriate prophylaxis has been administered, students should not attend classes and employees should not report to work.

703 - Drug-Free Campus

The College is committed to the maintenance of drug-free campuses.  Students and employees are prohibited from the unlawful manufacture, distribution, giving out, possession, or use of any narcotic drug, amphetamine, barbiturate, marijuana, alcohol, or any controlled substance while on campus or in any work place that is under the jurisdiction of the College.  In addition, the College has in place a detailed and comprehensive Student Code of Conduct policy which includes the prohibition of the possession, use, sale or distribution of alcoholic beverages on college property or at college-sponsored events on or off campus.  The Drug-Free policy is annually distributed to all MSC-ST students via the college’s student handbook, college catalog, the college website and via student e-mail.  The Student Code of Conduct is annually distributed to all MSC-ST students via the college’s student handbook, college catalog and via the college website. Information on the dangers of the misuse of alcohol and/or drugs is made available to students through the use of informational brochures placed in the student commons.  The college’s Student Senates on occasion sponsor activities for students that emphasize drug/alcohol-related topics such as the dangers of drinking and driving.

704 - Emergency Evacuation

Each Campus has an emergency evacuation plan located by the door in main offices and classrooms. The evacuation plan addresses fire and weather-related emergencies. Each Campus Administrator or his/her designee shall be responsible for initiating actions in accordance with the evacuation plan. Campus Administrators are the VP for Academic Affairs for Winona, and the  Chief Human Resources Officer for Red Wing.

705 - Ergonomics: Prevention of Musculo-Skeletal Disorders

The College will implement a preventative program on the identification and reduction of risk factors that can contribute to the probability of Musculo-Skeletal Disorders (MSD’s) of employees and students. Specific prevention methodologies, data collection requirements and responsibilities of supervisors and employees are outlined in the Ergonomics Procedures.

706 - Tobacco-Free Campuses

The College provides a tobacco-free environment in all buildings and college vehicles. Use of tobacco products, including E-cigarettes,  is not permitted within 75 feet of buildings except in designated areas. Violators of the policy will be subject to disciplinary action. (Students: see Policy No. 113 Student Code of Conduct)

Smoking” is defined as inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, pipe, or any other lighted or heated tobacco or other product intended for inhalation, in any manner or in any form. Smoking also includes the use of an e-cigarette which creates a vapor, in any manner or any form, or the use of any oral device for the purpose of circumventing the prohibition of smoking in this Policy.

“E-cigarette” means any electronic oral device, such as one composed of a heating element, battery, and/or electronic circuit, which provides a vapor of nicotine or any other substances for inhalation. The term shall include any such device, whether manufactured, distributed, marketed, or sold as an e-cigarette, e-cigar, e-pipe, or under any other product name or descriptor, but does not include any product specifically approved by the U.S. Food and Drug Administration for use in medical treatment, such as an asthma inhaler.

707 - Weapons Prohibited

Legal References: Minnesota State Board Policy 5.21

The use of any dangerous weapon, including firearms, in any building or other grounds/yard under the jurisdiction of the College, is prohibited. College personnel are prohibited to possess any dangerous weapon, including any firearm, while on official duty. Knives that are to be used as a teaching instrument may be exempted from this policy upon the approval of the President or the Vice-President of Academic Affairs.

 708 – Weather/Emergency Conditions

The College, due to inclement weather or other emergency conditions, may close or delay the opening of one or both of its campuses, or it may cancel classes and other activities. The President or their designee is responsible for this decision. 

Definitions   

  • Closing the College: All operations are shut down/closed except those deemed essential to the protection of life and property. The result is the cancellation of classes; and, student, faculty and staff activities and meetings. All general offices are closed. This policy includes classes/activities offered by other entities using college facilities, such as the CareerForce center. Only essential employees must report to work. 
  • Delayed Opening: All operations are kept closed for a designated period of time except those deemed essential to the protection of life and property. During the designated time period, only essential employees must report to work. 
  • Cancellation of Classes and/or Activities: Specific classes and/or activities are cancelled in lieu of officially closing the entire college. All college personnel must still report to the College following their standard work schedule. 
  • Essential Employees: Essential employees are those filling positions necessary for safe operations and services during closure or delayed opening.  The essential designation is assigned to the position, not a particular employee, in that if an employee is substituting for someone in an essential position, they would be considered an essential employee, even if their regular position is not essential. 

The following positions are designated as essential during weather or emergency conditions: All campus custodial and maintenance personnel.

709 - Animals on Campus

Minnesota State College Southeast shall provide a safe environment for all students, employees, visitors and guests by establishing and enforcing regulations for animals on campus. With the exception of those animals specifically exempted and defined by this document, animals are not allowed in college buildings or state vehicles. This policy and any related procedures apply to all buildings and all members of the campus community, as well as all individuals using campus buildings, including off-campus and leased properties.

Exemption Definitions

Subpart A. Service Animals: The work or tasks performed by a service animal must be directly related to the handler's disability. Examples of work or tasks include, but are not limited to, individuals who are deaf or hard of hearing to the presence of people or sounds, pulling a wheelchair, assisting an individual during a seizure, retrieving items such as medicine or the telephone, providing physical support and assistance with balance and stability to individuals with mobility disabilities, and helping persons with psychiatric disabilities by preventing or interrupting impulsive or destructive behaviors. The provision of emotional support, well-being, comfort, or companionship does not constitute work or tasks for the purposes of this definition.

According to the Americans with Disabilities Act (ADA), service animals are defined as dogs that are individually trained to do work or perform tasks for people with disabilities. Examples of such work or tasks include guiding people who are blind, alerting people who are deaf, pulling a wheelchair, alerting and protecting a person who is having a seizure, reminding a person with mental illness to take prescribed medications, calming a person with Post Traumatic Stress Disorder (PTSD) during an anxiety attack, or performing other duties. Service animals are working animals, not pets. The work or task a dog has been trained to provide must be directly related to the person's disability. Dogs whose sole function is to provide comfort or emotional support do not qualify as service animals under the ADA.

Subpart B. Animals for Educational Purposes: Animals and animal cadavers utilized for teaching and learning or for special events and instructional demonstrations.

Subpart C. On-duty Police dogs: Police dogs are allowed on campus.

Responsibility

The College is NOT responsible for the care or supervision of a service animal. Under the ADA, service animals must be harnessed, or tethered, unless these devices interfere with the service animal's work or the individual's disability prevents using these devices.  In that case the individual must maintain control of the animal through voice, or other effective controls. All service animals must be housebroken. If security or college personnel discover an animal not under control, the may call the police.

Enforcement

Responsibility for enforcement of this policy is primarily the Security Department; however, all MSCS employees are responsible for the enforcement of this policy. When it is not obvious what service an animal provides, only limited inquiries are allowed. Staff may ask two questions: (1) is the dog a service animal required because of a disability, and (2) what work or task has the dog been trained to perform. Staff cannot ask about the person's disability, require medical documentation, require a special identification card, or training documentation for the dog, or ask that the dog demonstrate its ability to perform the work or task.
